Terms of Service

These Terms of Service govern the use of duedigital.eu, operated by GJG B.V. under the brands duedigital and Ingoodkompany. By accessing or using the platform, the user agrees to be bound by these Terms.

duedigital.eu is a technology platform, not an advisory firm. The platform provides automated analyses, insights, and recommendations generated through software-based processes. Such outputs are inherently probabilistic in nature and may be incomplete, inaccurate, or not applicable to specific circumstances.

The user explicitly acknowledges that no reliance should be placed on outputs without independent verification, that the platform does not replace human expertise, and that use of the platform is entirely at the user's own risk.

Nothing provided through the platform shall be construed as legal, financial, technical, or other professional advice.

The user remains solely responsible for all decisions, actions, and outcomes arising from the use of the platform. It is the user's obligation to independently assess, verify, and validate any output before relying upon it in any way.

The platform and all associated outputs are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, all representations and warranties, whether express, implied, statutory, or otherwise, are expressly excluded.

Without limitation, no warranty is given that the platform will be uninterrupted, error-free, secure, or fit for any particular purpose, nor that outputs will be accurate, complete, or reliable.

To the maximum extent permitted by law, GJG B.V., including its brands duedigital and Ingoodkompany, shall not be liable for any damage of any kind arising out of or in connection with the use of, or inability to use, the platform.

This exclusion applies regardless of the legal theory invoked and includes, without limitation, direct, indirect, incidental, consequential, and punitive damages, as well as loss of profits, business interruption, loss of data, or loss of opportunity.

Insofar as any liability cannot be excluded under applicable law, such liability shall be strictly limited to an amount of €0 (zero euros).

GJG B.V. does not guarantee continuous or uninterrupted availability of the platform and reserves the right to modify, suspend, or discontinue the platform at any time without prior notice.

All intellectual property rights in and to the platform remain the exclusive property of GJG B.V. No rights are granted other than a limited right of use in accordance with these Terms.

GJG B.V. reserves the right to suspend or terminate access at its sole discretion, with or without notice.

These Terms are governed exclusively by the laws of the Netherlands. Any disputes shall be submitted exclusively to the competent court in the Netherlands.
